Significant influence and control! Who is the beneficial owner?

The meaning of “Significant influence and control” plays a key role in a world where the concept of fiscal transparency is increasingly important. By the way, in December 2015, the UK Department for Business Innovation & Skills published a draft statutory guidance in order to determine whether, in the context of companies, a person is a “person with significant control”.

The draft guidance states that significant influence and control are concepts that should be considered in the alternative. On one side, a position of significant influence exists where a person is able to exercise his influence to ensure that the company, or trust, adopts certain policies or conducts certain activities and, on the other side, a person has the control of a company when he holds the powers to direct the policies and activities of the company.
