The Regulatory Protocol of measures for countering and containing the spread of Covid-19 virus in working environments, signed on April 24, 2020 between social players and the Government, states that all personnel may undergo the body temperature control, as long as the employer defined and implemented all the security measures, both under the technical and organisational terms as set in the personal data protection legislation.
The record keeping of the body temperature data, and the identification of data subjects, can only be admissible if it is necessary to prove the reasons for denying the access.
The worker, in that case, is not obliged to justify for exceeding the temperature threshold, but it could be asked to undergo regular health examination, in compliance with the provisions of article 5, EU Regulation 2016/679 (GDPR).
